ON A PLOD – PARTICIPANT WAIVER, ASSUMPTION OF RISK & TERMS OF PARTICIPATION

IMPORTANT LEGAL NOTICE

This document forms a legally binding agreement between you (“the Participant”) and On A Plod Ltd (“the Organiser”).

By ticking the acceptance box during checkout, you confirm that you:

  • Have read this agreement in full
  • Understand its contents
  • Agree to be legally bound by it

If you do not agree, do not purchase a ticket or participate in the Event.

1. Assumption of Risk

I acknowledge that participation in the Event involves inherent and foreseeable risks, including but not limited to:

  • Physical exertion and fatigue
  • Trips, slips, falls, and collisions
  • Uneven, wet, or slippery surfaces
  • Weather conditions
  • Contact with other participants, spectators, members of the public, vehicles, or obstacles
  • Risk of injury ranging from minor injury to serious injury

I voluntarily and knowingly accept and assume all risks arising from my participation, whether caused by my own actions, the actions of others, environmental conditions, or the nature of the Event.

2. Fitness, Health & Medical Responsibility

I confirm that:

  • I am 18 years of age or older
  • I am physically and medically fit to participate
  • I have not been advised by a medical professional to avoid physical activity
  • I understand that the Organiser has not assessed my fitness or health

I accept full responsibility for monitoring my physical condition during the Event and agree to stop immediately if I feel unwell, injured, or unsafe.

3. Participant Responsibility & Conduct

I agree that I:

  • Participate entirely at my own risk
  • Am responsible for my own hydration, nutrition, pacing, and decision-making
  • Will comply with all reasonable instructions given by event staff, marshals, or volunteers
  • Will behave responsibly and respectfully

The Organiser reserves the right to remove any participant whose behaviour is unsafe, disruptive, or inappropriate, without refund.

4. Limitation of Liability (Key Clause)

To the maximum extent permitted by law, I agree that On A Plod Ltd, including its directors, officers, employees, volunteers, contractors, partners, sponsors, landowners, and venue operators shall not be liable for any loss, damage, injury, or claim arising from my participation in the Event.

This includes (without limitation):

  • Personal injury
  • Property loss or damage
  • Financial or economic loss
  • Indirect or consequential loss

Nothing in this agreement excludes or limits liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded.

5. Indemnity

I agree to indemnify and hold harmless the Organiser and all associated parties against any claims, actions, losses, or proceedings brought by me or on my behalf, or by third parties, arising out of my participation in the Event, except where caused by negligence that cannot legally be excluded.

This includes legal costs on a full indemnity basis.

6. Personal Property

I acknowledge that participation is at my own risk with respect to personal belongings. The Organiser accepts no responsibility for loss, theft, or damage to personal property.

7. Photography, Video & Media Release

I grant the Organiser the unrestricted right to record, photograph, and film me during the Event and to use such media for promotional, marketing, commercial, and archival purposes without compensation.

8. Alcohol & Post-Event Activity

Where alcohol is available:

  • Consumption is voluntary
  • I remain solely responsible for my actions
  • The Organiser accepts no responsibility for incidents arising from alcohol consumption

Participation in the Event and any post-event social activity are entirely voluntary and at my own risk.

9. Governing Law & Jurisdiction

This agreement is governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Acceptance & Electronic Agreement

By ticking the acceptance box at checkout, I confirm that:

  • I have read and understood this agreement
  • I accept it voluntarily
  • I agree to be legally bound by its terms

This agreement is enforceable under the Electronic Communications Act 2000 and constitutes a legally binding electronic contract.
